UPDATE: Supreme Court Stays 5th Circuit Decision For Review

The stay reference below has been extended by the U.S. Supreme Court until Thursday May 14th at 5 p.m. EST.


May 4th 2026:

Following the 5th Circuit Court of Appeals decision on Friday, May 1st, the U.S. Supreme Court granted a seven-day “administrative stay” while the appeal proceeds so that all parties can brief the Supreme Court and justices have time to review the case.

Erica Inzina, J.D., Policy Director for Louisiana Right to Life, has issued the following statement:

“No surprise, but since their abortion pill profit has been threatened, the businesses that manufacture and sell the abortion pill are appealing to the U.S. Supreme Court following Friday’s decision. It has never been about safety but instead it has always been about the money. The court has granted a seven-day “administrative stay” while the appeal proceeds. Let’s pray for a positive decision from the Supreme Court that will stop the reckless online sale of abortion pills without a doctor’s oversight!”

It is important to remember the following facts:

  • It is still illegal under Louisiana law for abortion pills to be sold and shipped through the mail.  Today’s Supreme Court “stay” does not change that fact.
  • The issue in question is whether a federal provision that President Biden put in place in 2023 that allowed abortion pills to be sold online and shipped through the mail without a doctor’s in-person oversight.
